Civil-Litigation-law-homework-help

When a paralegal sends a request for admission to a defendant, they are asking that the second party admit to the truthfulness of some fact or opinion. If the statement is admitted, the statement is no longer in dispute, and by the use of this discovery tool, it simplifies a lawsuit by reducing the number and nature of the points in controversy.

Your supervising attorney has asked that you draft a set of requests for admission on behalf of your client Abel, against his brother Cain in our car accident case. Think about the facts that you would want Cain to admit, to simplify the lawsuit. You should have at least 10 separate requests for admission. A sample has been provided for you below.  Here are some facts about the case:

Your supervising attorney, Jake Smalls, has already served an Answer and Counterclaim on behalf of Abel, based off of a conversation with Abel, who has given him the following information:

  • He got into an accident with his brother, but his brother turned out into the lane in front of him, causing the accident.
  • He believes his brother was intoxicated at the time and was speeding.
  • He knows his brother went to the hospital, but is unsure of the extent of his injuries or medical bills. He is sure, however, that his brother is faking some of his injuries–he saw him moving furniture shortly after the accident. This also leads him to believe he could still perform his job.
  • He is furious with his brother, and wants to sue him for defamation. His brother has been going around town telling “everyone” that he intentionally ran him over because he thought Cain was going to tell Abel’s wife about an affair Abel was engaged in.
  • Abel adamantly denies hitting his brother on purpose, and is furious, as he has never engaged in an affair. Regardless, news of his brother’s statements about him have spread amongst the town, and Abel recently lost an election whereby he was running for the Blackacre School Board. Polling showed he lost the election due to the public’s concern over his moral fitness.

Internet-and-Children-Research-Question-help

This week you’re going to take a few more steps towards creating an annotated bibliography by finalizing your research topic and writing your research question.

Read Module 1 of your textbook, and watch Picking Your Topic IS Research

Last week, you were asked to start thinking about the topic you’d like to choose for your annotated bibliography. You can refer to the list of possible research topics if you need help thinking of a topic. After reading Module 1 of your textbook and watching Picking Your Topic IS Research, you learned that you should do some research on the topics that you are considering to learn more about your topic and check out the sources that are available.  If you haven’t yet done any background research on the topics you are considering, you should do that now.  This is the point in the research process when it is acceptable to use Wikipedia or other general reference works like encyclopedias and almanacs. 4 Easy Steps to Using the Ashford Library for Background Research can help you get started.

Choosing your research topic is the next step.  Remember that you will be working with this topic for the rest of this class, so you should choose something that you find interesting.  It is recommended that you choose a topic you would like to investigaterelated to your major.

The next step is to do some brainstorming about your topic. Brainstorming will help you think about your topic from different angles and consider different aspects of your topic.  There are a number of different brainstorming methods, like asking questions about your topicoutlining, and creating concept maps using websites likebubble.us and Mindmeister.  You can use any of these tools, or you can just put pencil to paper and let the ideas flow.

The last step this week is to consider and write your research questions and reflect on the process. The Writing Your Research Question will lead you through the process of creating research questions.  You must create at least three research questions that are open-ended; address a controversy, issue, or problem; and address your topic in a way that you can take a stand. Writing an open-ended question is sometimes a challenge so take a look at the How to Ask an Open-Ended Question handout before you get started.

Then, you will reflect on the process of doing background research and refining your topic.

Note: You are only required to submit the Creating Your Research Question worksheet this week. (which is the GEN103_WK2_Writing_Your_Research_Question.docx document, so please fill that out)

Just in case you can’t open the links that are listed in the paragraph, I have attached everything you need.

Please use the files attached to help you with this assignment.

Once again, my research TOPIC is Internet and Children, so anything you can find on that is good.

ALL YOU HAVE TO DO IS THE CHART!!!!!!

Identify 2 specific differences and 2 similarities between each perspective as it relates to punishment

The classical view of punishment was fueled by the notion that offenders were evil men and women who had to be punished severely or killed for their egregious acts. It was felt that the demons that possessed the offenders would never leave except by expiation and punishment.

As the influence of natural and social science grew, many individuals began to reexamine the widely accepted idea that crime resulted from demonic possession, free will, or mental imbalance. Positivists took a progressive stance and began to analyze the causes of crime and punishment.

Prepare an essay (3–4 pages) on the differences between the classical and positivist approaches to punishment.

Assignment Guidelines:

  • Use your course materials, the textbook, the Web resources, and the library to research the classical and positivist approaches to punishment.
  • In a Word document of 3–4 pages, address the following:
    • Identify 2 specific differences and 2 similarities between each perspective as it relates to punishment.
    • Examine 2 of the social arguments used to support both schools of thought.
    • Out of the 2 schools of thought, which do you agree with most?
    • Include 3 philosophical or social issues that could be used to support either model.
  • Reference all sources using APA style.
