Federal judges are appointed by the president and confirmed by the Senate. The president is likely to appoint judges that share his or her political ideologies. Since federal judges serve on the bench for life, their appointments have a lasting impact on the composition of the courts and judicial outcomes. Therefore, it is important to consider how judges make decisions that affect law and public policy. While judges are supposed to remain impartial in their decision making, some evidence suggests that their political ideologies influence how they interpret the Constitution and make decisions about cases. To prepare for this Discussion:

• Review the article, “Federal Judge Selection: Process and Participants.” Think about how politics influence judge selection. .
• Review the article, “Students Fourth Amendment Rights and the Federal Judgeship: Examining the Link between Political Appointments and Case Outcomes.” Consider how judges’ political leanings or party affiliations might impact how they interpret the Constitution and decide on cases.
• Consider how politics might influence the selection process of federal judges.
• Think about how federal judges’ political ideologies might influence judicial outcomes.

Because public and nonprofit administrators operate in a complex world, they often ask research questions that can be answered with multiple explanations. Multiple explanations for an outcome require multiple independent variables. As a reminder, independent variables are those that influence the outcome or dependent variable. For example, consider research designed to explain why some students earn good grades in Applied Research and Evaluation, while others do not. Perhaps one independent variable, such as time spent studying, explains good grades versus poor grades (dependent variable). However, it is more likely that many independent variables are involved. It could be that time spent studying, along with previous experience taking a research methods course, and the amount of time spent at a job, contributes to the explanation. Simple associational research, such as the research you considered in Week 9, overlooks the complexity of multiple variables because it focuses only on one independent variable.

Explanations that involve multiple independent variables are better served by approaches such as OLS regression or binary logistic regression analysis. The choice often depends on the nature of the dependent variable. An interval dependent variable may lead you to choose OLS regression, while a nominal dependent variable may require binary logistic regression. OLS is a simple, yet limited approach to regression. You must assume that variables are related in a linear fashion, and the dependent variable must be somewhat interval in nature. Research does not always present interval-dependent variables. There are situations, however, in which dependent variables are more nominal in nature. Assume that you want to predict the likelihood of an individual leaving the organization in the next six months. The dependent variable in this example would be nominal (either he/she leaves or he/she does not). OLS regression would not work in this situation, so you would need another type of regression, known as binary logistic regression. There is no “perfect” approach to regression analysis. Rather, you must select the “most appropriate” type of analysis, depending on the purpose of your research and the types of variables you are examining.

Post by Day 4 an explanation of whether OLS regression or binary logistic regression is more appropriate to evaluate the program, problem, or policy you selected for United Way. Explain how you would use the selected analysis, and justify why this type of regression analysis is most appropriate.

  Choose one (1) of the three (3) reading selections from the list of topic choices below. The focus is on brief but important primary source material written by major authors. Read the selections  as identified with each topic below. Write a three to four (3-4) paragraph essay (250 words minimum) which analyzes the “surprise ending” of the reading selection. 

Topic Choices

• Reading selection from Descartes’ Discourse on the Method (Part IV). Descartes begins with a  proof of one basic conclusion and ends with a proof of something much grander. Remember to focus on the surprise and point of realization, not the details of the philosophical argument. Read Part IV of the Discourse on the Method located at http://www.earlymoderntexts.com/assets/pdfs/descartes1637.pdf (then scroll down to Part 4, pp. 14-18). This is only four or five (4 or 5) pages of the larger work.
   
• Reading selection of Swift’s A Modest Proposal. It is essential to recognize the genre of this work, as discussed in our class text, which you should consult and cite. Swift promotes a radical solution, but subtle options are mentioned. You are looking for surprise and a point of realization. Read and focus on A Modest Proposal located at http://www.victorianweb.org/previctorian/swift/modest.html. 
• Two (2) reading selections from Voltaire’s Candide. Consider how these readings start and end in terms of the action and the beliefs. You are looking for surprise and a point of realization. These selections can be found on pp. 840-841 in the textbook. In addition, consult the class text at pp. 824-825.

For the reading selection you choose:

1. Clearly state in your own words the “surprise ending” in the reading you selected. Clearly identify the point in the reading when you realized that there were elements in the reading that surprised you. Not all of the surprises come at the end.
2. Evaluate how successful the author was in convincing you to accept the validity of the “surprise ending” that was different from what you expected. 

Your assignment must follow these formatting requirements:

• Be typed, double spaced, using Times New Roman font (size 12), with one-inch margins on all sides; citations and references must follow APA Style format. Check with your professor for any additional instructions. (Note: Students can find APA style materials located in the Additional Resources section of their Student Center within their course shell for reference)
• Include a cover page containing the title of the assignment, the student’s name, the professor’s name, the course title, and the date. The cover page and the reference page are not included in the required assignment page length.
• Use the source(s) identified above for the topic you choose, focusing on the main primary source of that author.
