Admit that Constitutional rights are precious, but are always balanced against the prevailing good, like seat belt laws, pollution laws, etc. Another argument might be that some southern states would suffer extreme economic hardship because their economy is based on tobacco. (Think, for example, what might happen to Michigan if automobiles were banned.) The counter argument might be some sort of government help to change to a different crop or work basis. Lastly consider the argument about longevity. This is an absurd rationalization (logical fallacy) made by some smokers and can be dismissed as such.
2. Fairness. By considering the opposition, it shows that you are reasonable, and have, yourself, considered both sides.
